Methodology and Guidance for PPP Preparation and Procurement

This Guidance aims to provide public authorities and PPP practitioners throughout Romania with a concrete roadmap and methodology for preparing and procuring PPP projects. Although the concepts in this Guidance may also be applicable to concession projects, the scope of this document is limited to PPPs, given that (unlike in some other legal systems) Romanian law makes a distinction between PPPs and concessions, as described below. The framework stipulated in this Guidance is informed by PPP preparation and procurement processes and approaches in PPP markets globally and has been tailored to the Romanian PPP context.

This Guidance aims to provide public authorities and PPP practitioners throughout Romania with a concrete approach and methodology for defining and assessing Value for Money (VfM) for PPP and Concession projects to determine whether to use PPP or concession as a project procurement approach. The framework stipulated in this Guidance is informed by VfM practices in mature PPP markets in Europe and world-wide and has been tailored to the Romanian PPP context.

This Guidance aims to provide public authorities and PPP practitioners throughout Romania with a concrete approach and methodology for conducting risk management for PPP projects. Although the Guidance may also be used for concession projects, the scope of this deliverable shall be limited to PPPs, given that (unlike in other legal systems) Romanian law makes a distinction between PPPs and concessions, as described below. This Guidance aims to provide public authorities and PPP practitioners in Romania with an approach andmethodology for conducting affordability assessment for PPP projects. The framework stipulated in this Guidance is informed by affordability assessment approaches in PPP markets globally and has been tailored to the Romanian PPP context. One of the main causes of PPP project failure, both in Romania and other markets, is that they turn out to be unaffordable either for Government or for users due to poor initial assessment. Assessing affordability is therefore one of the key tasks in the preparation and procurement of a PPP project.

This Guidance aims to provide public authorities and PPP practitioners in Romania with a concrete approach and methodology for defining and assessing the impact of PPP and Concession projects on government debt and deficit. The framework prescribed by this Guidance is informed by government debt and deficit impact assessment practices in mature PPP markets in Europe and provides guidance on how these may be applied in the Romanian PPP context.

PPP Contract Guidance

This document sets forth a set of guidelines and commentaries concerning the main substantive clauses that are expected to be contained in Romanian PPP contracts. This Contract Guidance is intended to assist Romanian contracting authorities and entities understand the purpose and effect of the substantive clauses contained in PPP contracts as well as to understand if/how to use, complete or adapt them in the context of specific PPP projects.
